PROPOSAL
PUBLIC & PRODUCTS LIABILITY
IMPORTANT NOTICE
1. YOUR DUTY OF DISCLOSURE
Before you enter into a contract of insurance with Dominion
Underwriting Agents Pty Limited you have a duty, under the
INSURANCE CONTRACTS ACT, 1984, to disclose to Dominion Un
derwriting Agents Pty Limited every matter that You know,
or could reasonably be expected to know, is relevant to our de
cision whether to accept the risk of the Insurance and, if so,
on what terms. You have the same duty to disclose
these matters to DOMINION UNDERWRITING AGENTS PTY LIMITED
before you renew or change this contract. Your duty,
however, does not require disclosure of any matter –
that diminishes our risk;
that is of common knowledge;
that we know, or in the ordinary
course of business, should know;
as to which compliance with Your duty of disclosure is
waived by Dominion Underwriting Agents Pty Limited.
NON-DISCLOSURE
If you failure to comply with Your duty of disclosure we may
be entitled to reduce our liability under the contract in respect
of a claim or may cancel the contract. If your non-disclosure
is fraudulent, we may also have the option of avoiding the
contract from its beginning.
2. SUBROGATION
Your Policy of Insurance provides that you will not be able to
recover under it if you enter into or have entered into any
agreement which excludes or limits your right of recovery fr
om other parties; therefore You MUST NOT have agreed and
MUST NOT agree to give away any of your rights because that
will affect our right to recover from those other parties.
